1. Introduction

This website is operated by VisionFX. Throughout the site, the terms "we", "us", and "our" refer to VisionFX. VisionFX provides this website, including all information, tools, and AI-generation services (the "Service") available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By accessing our site, creating an account, or purchasing something from us, you engage in our Service and agree to be bound by these Terms of Service, including the Acceptable Use Policy in Section 6 and any additional terms and policies referenced herein. These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, and contributors of content.

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

2. Use of the Service

You are permitted to use this website for browsing the content we have made available and for generating content through our AI tools, subject to these Terms and the Acceptable Use Policy. The Service must not be used for any illegal or unauthorized purposes. You agree to comply with all applicable laws, rules, and regulations (including export control, sanctions, intellectual property, and privacy laws) in connection with your use of the website and its content.

3. Access

We reserve the right, at our sole discretion, to withdraw or modify this website and any service or material we provide on the website, without notice. We will not be liable if, for any reason, all or any part of the website is unavailable at any time or for any duration. We further reserve the right to suspend or terminate your account, with or without notice, if we determine in good faith that you have violated these Terms or the Acceptable Use Policy.

4. Intellectual Property Rights

All software, branding, models, design, text, and materials made available through the Service are the property of VisionFX or its licensors and are protected by copyright, trademark, and other relevant laws. Subject to your compliance with these Terms, you retain ownership of the prompts you submit and, to the maximum extent permitted by applicable law, of the AI-generated outputs produced for your account, while granting VisionFX a worldwide, non-exclusive license to host, store, transmit, and (where you have opted-in to public sharing) display such content as necessary to operate and improve the Service.

5. User-Submitted Content

You are solely responsible for any prompts, reference images, audio, video, or other content you upload, submit, or otherwise provide to the Service ("User Content"). You represent and warrant that you own or have all necessary rights in your User Content and that your User Content and its use through the Service do not violate any third-party rights or applicable law.

6. Acceptable Use Policy (AUP)

The Service includes generative AI capabilities. Because such capabilities can be misused, we apply the following Acceptable Use Policy to all use of the Service. Violations may result in immediate suspension or termination of your account, removal of content, forfeiture of unused credits, and reporting to law enforcement where required.

You may NOT use the Service, and you may not submit prompts, reference media, or generated outputs that:

6.1 Sexual / NSFW Content

  • Depict, describe, or solicit pornography, sexually explicit content, sexual acts, sexual nudity, fetish content, or any other not-safe-for-work ("NSFW") sexual material.
  • Generate non-consensual intimate imagery ("revenge porn"), upskirt/voyeur content, or sexualized depictions of identifiable real persons without their explicit, documented consent.

6.2 Child Safety

  • Generate, request, store, or distribute Child Sexual Abuse Material ("CSAM") or any sexual, suggestive, or exploitative content involving minors (real or fictional, photorealistic or stylized). This is an absolute prohibition; we report violations to the National Center for Missing & Exploited Children (NCMEC) and equivalent authorities.
  • Depict minors in violent, frightening, or otherwise harmful contexts.

6.3 Real People, Public Figures, and Likeness

  • Create non-consensual deepfakes, impersonations, or synthetic likenesses of real, identifiable individuals (including celebrities, politicians, and private persons) — particularly in sexual, defamatory, criminal, harassing, or politically deceptive contexts.
  • Use the Service to commit identity theft, impersonate another person, or generate forged identification documents, signatures, or government-issued credentials.

6.4 Violence, Hate, and Harassment

  • Generate content that promotes, glorifies, or incites violence, terrorism, genocide, self-harm, or suicide.
  • Generate hateful, harassing, or discriminatory content targeting individuals or groups based on race, ethnicity, religion, gender, gender identity, sexual orientation, disability, or other protected characteristic.
  • Generate gore, torture, or graphic injury imagery designed to shock or harm.

6.5 Illegal Activity and Regulated Goods

  • Generate content depicting, promoting, or providing instructions for illegal activity, including the manufacture or use of weapons, explosives, illicit drugs, or controlled substances.
  • Generate counterfeit currency, securities, or other items intended to defraud.

6.6 Fraud, Deception, and Disinformation

  • Generate content intended to defraud, scam, phish, or otherwise deceive third parties for financial or political gain.
  • Generate election-related disinformation, fabricated news events, or content falsely attributed to real journalists, outlets, or officials.

6.7 Malware, Security, and Platform Abuse

  • Use the Service to develop or distribute malware, ransomware, spyware, or other malicious code.
  • Reverse-engineer, scrape, or otherwise circumvent the Service's safety filters, rate limits, watermarking, or access controls; resell raw API access; or use automated means to overload the Service.

6.8 Privacy Violations

  • Generate content that exposes another person's private, personal, financial, medical, or location data without lawful basis and consent.

7. Content Moderation and Enforcement

To enforce this AUP and comply with our payment processors' requirements, prompts and generated outputs are subject to automated content moderation, including third-party moderation services. We may, at our sole discretion: (i) refuse to process a prompt; (ii) refuse to deliver a generated output; (iii) remove content from your account or from public galleries; (iv) suspend or terminate accounts; and (v) preserve and disclose content and account information where required by law or to protect the rights, property, or safety of VisionFX, our users, or the public.

If your generation request is blocked by our safety system, your credits for that request will not be deducted (or will be refunded automatically where deduction has already occurred). Repeated submission of prohibited prompts may result in account termination without refund.

8. AI-Generated Output Disclaimer

AI-generated outputs are produced by probabilistic models and may be inaccurate, biased, offensive, or otherwise unsuitable. Outputs are provided "as is" and should not be relied upon as professional advice (legal, medical, financial, or otherwise). You are solely responsible for reviewing outputs before publication and for compliance with all laws and platform rules in your downstream use of those outputs, including any obligation to disclose that content is AI-generated.

9. Disclaimer of Warranties & Limitations of Liability

This website, along with all the information, content, and materials, is provided by VisionFX on an "as is" and "as available" basis. VisionFX makes no representations or warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated outputs.

To the maximum extent permitted by applicable law, VisionFX will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of this website or any AI-generated content.

10. Indemnification

You agree to indemnify and hold harmless VisionFX, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your use of AI-generated outputs, or (d) your violation of these Terms or the Acceptable Use Policy.

11. Governing Law

These Terms will be governed by and interpreted in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

12. Changes To Terms of Service

The most current version of the Terms of Service can always be reviewed on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. Material changes will be effective upon posting; your continued use of the Service after such posting constitutes acceptance of the revised Terms.
